Violence in the Workplace - OSHA's New Compliance Directive

Violence in the Workplace. We hear about it every once in a while, yet it seems like it's happening more often, and for every incident that we hear or read about in the news, there are many other smaller incidents that occur across the country each day that we don't hear about. Workplace violence probably wouldn't or couldn't happen at your company-right? Or could it? Employers can be held liable for workplace violence when it can be shown there was negligent hiring, negligent retention, negligent security, and/or inadequate safeguards to provide a “safe and healthful workplace”.

OSHA issued on September 8, 2011, for the first time ever, a Compliance Directive, CPL 02-01-052, titled “Enforcement Procedures for Investigating or Inspecting Incidents of Workplace Violence”. The directive establishes uniform procedures for OSHA field staff for responding to incidents and complaints of workplace violence and conducting inspections in industries considered vulnerable to workplace violence, such as healthcare and social service settings, and late-night retail establishments. This instruction establishes OSHA general enforcement polices and procedures for field offices to apply when conducting inspections related to workplace violence. The instruction highlights the steps that should be taken in reviewing incidents of workplace violence when considering whether to initiate an inspection in industries that OSHA has identified as susceptible to this hazard. The instruction is meant to provide guidance on both how an OSHA workplace violence case is developed and which steps Area Offices should take to assist employers in addressing the issue of workplace violence.

By utilizing these recommendations, you should be able to better identify methods for reducing the likelihood of violent incidents occurring. Cover the comprehensive list of best practices outlined in the Directive, CPL 02-01-052.

Share the signs experts say employers should look for as indicators of a possible onset of violent behavior.

Identify the common characteristics and the profile of perpetrators of workplace violence and discuss what preventative steps should be taken if management suspects that someone is displaying a propensity toward violence or is becoming violent.

Discuss the legal issues of managing a violent, disruptive employee and how the Americans with Disabilities Act may complicate matters.
